ACDP teen vaccine hearing postponed

The Gauteng High Court today granted a request by the ACDP for a postponement in the hearing of its urgent application for an order to stop the rollout of Covid-19 vaccinations to children between the ages of 12 and 17,

ACDP national executive committee member and attorney Bongani Luthuli said in a statement that the postponement was requested for the hearing which was due to start today because the Minister of Health, who is opposing the application, only filed his papers at about 4pm yesterday, which did not afford the ACDP and other applicants adequate time to respond.

The medical regulatory authority Sahpra, which is also opposing the application, has also not yet filed its papers and the matter centres squarely on the regulator authorising vaccination of teens under Section 21 of the Medicines Act, said Luthuli.

He said Judge Fourie postponed the hearing sine die and the matter is now before the deputy judge president who the ACDP had petitioned to allocate dates for the hearing.

“The matter is complex and therefore requires that about two days should be afforded in its hearing so that issues are ventilated properly. And we shall get a directive from the DJP as soon as he is ready for us,” said Luthuli.

The ACDP is supported in its application by Free the Children – Save the Nation, the Caring Health Workers Coalition and the Covid Care Alliance.

The ACDP opposed vaccinating children against Covid-19 because there was insufficient evidence to warrant it, Luthuli said last week, according to a report in Sowetan.
