Despite denials from CRL Rights Committee chair Thoko Mkwanazi-Xaluva that the CRL intends to push for state regulation of religion and her assertion that the CRL respects the right to religious freedom guaranteed by the Constitution, the draft white paper and legislative framework produced by the CRL’s Section 22 Committee tell a very different story, says Michael Swain executive director of Freedom of Religion South Africa (FOR SA)
“Although this committee has not yet conducted a single public meeting or consultation, this 32-page document details the intention to impose a draconian system of state regulation. This would fundamentally reset the relationship between the State and South Africa’s religious communities,” he says.
